Advanced Consent
You understand that this consumer transaction involves your advanced consent (also called a negative option), and you may be liable for payment of future goods and services, under the terms of this agreement, if you fail to notify the supplier not to supply the goods or services described.

For future purchases, DermaPlus, Inc reserves the right to make any modifications and changes (to these terms and conditions) that are deemed necessary—at any time— without any prior notification.

"Client", "I", "you" or "your" shall mean the person or persons using, or paying for shipping to try products on this website. Trial Terms and Conditions
The 21 day Trial offer is designed to display the quality and effectiveness of DermaLastyl® products. This gives you the opportunity to try this remarkable program for $4.95 so you can come to a decision for yourself if this is the right product for you.

Upon ordering, you agree to pay the shipping and handling fees for the full size bottle. You'll have 21 days from the date of your order ships to evaluate the product and see the results for yourself. When you notice significant results, simply do nothing. You will be billed the super low price of $71.20 at the end of your 21-day trial period.

21 DAY TRIAL PERIOD INCLUDES SHIPPING AND TRANSIT TIME
You are not obligated to purchase after you receive your incredible trial bottle and you may cancel anytime by calling 1-877-434-0153 Monday thru Friday 9AM-5:300PM Eastern Standard Time within the 21 day cancellation period. If you decide to cancel, you will be required to call our Toll-Free number and request an RMA (Return Merchandise Authorization) number. Once you recieve your RMA number from one of our agents, you will be required to return the remaining product to our returns department. Your return must be Post Marked within the 21 day Trial Period and shipped through USPS. We cannot process or refund packages marked "Return to Sender." Any returns postmarked after the Trial Period or not returned through USPS will not be refunded for the initial bottle. Any returns made for this bottle, even if returned improperly, will automatically disqualify you to recieve a monthly supply of DermaLastyl at a discounted rate and you will not be billed again.

If you are happy with your one-month supply of DermaLastyl®, do nothing and your card will be charged an aditional $71.20 approximately 21 days after you placed the order for your trial shipment. In addition, aproximately 60 days after you place your trial order for DermaLastyl and about every 60 days thereafter, we will automatically send you a 60-day supply of DermaLastyl. The credit card you provid today will be billed the Preferred Customer price of $71.20 plus free shipping and handling for a total of $71.20 when each new product ships. That's 20% off the regular price for a 60-day supply of DermaLastyl, normally $89 per bottle. You can cancel anytime.

YOU UNDERSTAND THAT THIS CONSUMER TRANSACTION INVOLVES A NEGATIVE OPTION AND THAT YOU WILL BE LIABLE FOR PAYMENT OF PRODUCT THAT WAS SHIPPED TO YOU, AND FUTURE SHIPMENTS OF PRODUCT, IF YOU FAIL TO NOTIFY US TO STOP SUPPLYING THE PRODUCT TO YOU.

Upon submitting your order for the trial product and not contacting us to cancel, you agree to pay the recurring monthly charges using the debit/credit card used during your trial order. You hereby provide pre-authorization and consent that DermaPlus, Inc may charge $ 71.20 on a bi-monthly basis. You may stop payment on any pre-authorized charge by notifying DermaPlus, Inc at least three business days prior to the scheduled charge date. You agree that your pre-authorization and electronic signature is sufficient to authenticate your authorization to charge the credit/debit card electronically. You further agree that these terms and conditions shall be your copy of your pre-authorization for the credit/debit card. DermaLastyl® Return Policy
We have a 30-day satisfaction guarantee return policy on all products.

Returns
If you are unsatisfied with our product, you may return the unused portion 30 days from the date that the product was originally shipped to you for a refund according to the following terms. To obtain a refund, your return must be postmarked 30 days from the date that the product was originally shipped to you. We do not refund or credit shipping charges for any monthly shipments. Please note, the following terms apply for all returned items:

To return a product for an exchange or refund you will need to obtain a Return Merchandise Authorization (RMA) number by contacting the customer service department at 1-877-434-0153.

An RMA number can ONLY be obtained by contacting the billing department at 1-877-434-0153.

Please Note:
  1. We cannot process or refund packages marked "Return to Sender."
  2. Refunds will be issued to the same credit card that was charged when ordering the product.
  3. To ensure a refund is processed for you, please send returns to the address provided along with your RMA number. The RMA number must be clearly written on the package that you are sending back. Our shipping department is NOT allowed to accept any packages without an RMA number.

We are not responsible for lost or stolen items. We recommend all returned items to be sent using some type of delivery confirmation system to ensure proper delivery.

After the shipping department receives your return, it generally takes 2 business days or sooner to process your refund. Once a return is processed, it usually takes 3-5 business days for this return to be posted to your account, depending on your financial institution.

Shipping Terms
The standard ground mail service is shipped via the United States Postal Service First Class Mail. With our Expedited Shipping Option (if available), we will make your shipment our priority and ship these packages out the same day for all orders placed before 6PM EST and the next day for all orders placed after 6PM EST (packages will arrive within 1-4 business days). Please be advised that shipments are not sent out on Saturdays, Sundays, or any Holidays. We do not guarantee arrival dates or times. We do not refund or credit shipping charges for any monthly shipments.

Limitation of Liability
Under no circumstances, shall DermaPlus, Inc or any of its employees, directors, officers, agents, vendors or suppliers be liable for any direct or indirect losses or damages arising out of or in connection with the use of or inability to use this website.

This is a comprehensive limitation of liability that applies to all losses and damages of any kind (whether general, special, consequential, incidental, exemplary or otherwise, including, without limitation, loss of data, income or profits), whether in contract, negligence or other tortuous action, even if an authorized representative of any GS Labs, Inc has been advised of or should have known of the possibility of such damages.

If you are dissatisfied with this website, product, or any content on the site, or with these terms and conditions, your sole and exclusive remedy is to discontinue using this website and use of product recieved from this website. You acknowledge, by your use of this website, that your use of the site is at your sole risk.

Applicable law may not allow the limitation of liability set forth above, so this limitation of liability may not apply to you. If any part of this limitation on liability is found to be invalid or unenforceable for any reason, then the aggregate liability of DermaPlus, Inc, under such circumstances for liabilities that otherwise would have been limited, our maximum aggregate liability to you arising by reason of this transaction shall be the amount paid by you for the physical materials.

Indemnification
You agree to defend, indemnify and hold harmless us and our directors, officers, agents, and employees for any and all costs, fines, claims, damages, charges, or fees (including reasonable attorney's and expert witness' fees) arising by reason of your purchase or use of the web site resulting from Your misuse or inability to use the Website, or Your breach of any of these terms and conditions of this Agreement or arising from: Any breach of the agreement. Any claims arising from the sale or license of goods or services promoted or made available through this program except where limited by law. Our indemnity rights shall not be limited or offset by any contributory negligence by us.

Entire Agreement
This agreement constitutes the entire understanding with regard to your purchase and affiliation with the sponsor, and us and supersedes all prior representations, oral or written. If any provision, paragraph, or subparagraph of this agreement is adjudged by any court of law to be void or unenforceable, in whole or in part, the rest of the agreement shall remain in effect. The parties agree that in such event, the offending clause will be replaced with a provision or provisions having the same economic effect. This agreement shall be binding on, and shall inure to the benefit of, the parties to it and their respective heirs, legal representatives, successors and assigns.
